Scott E. Gwartney
Scott Gwartney joined Brooks, LeBoeuf, Bennett & Foster in 2002, and became a named partner in 2003. Mr. Gwartney, who hails from Tallahassee, is a magna cum laude graduate of Liberty University in Lynchburg, Virginia, and a 1991 graduate of the Florida State College of Law. He started his legal career as a clerk for Ken Connor, who tried one of the first nursing home cases in the state of Florida. Following graduation from law school, Mr. Gwartney joined Connor as an attorney specializing primarily in medical malpractice and nursing home litigation. The Connor and Gwartney firm joined their practice in 1998 with that of the Tampa-based nationwide nursing home litigation firm of Wilkes & McHugh. Scott passionately believes that our seniors deserve no less respect and level of dignity than that which is afforded to any other segment of our society. The results of Mr. Gwartney's experience and efforts on behalf of the elderly speak volumes about his level of expertise in nursing home abuse and neglect litigation. Along with Ken Connor, he tried the case of Letha Collins v. Beverly Enterprise-Florida, and the verdict in excess of $12 million remains the largest nursing home verdict in North Florida. During the two-week trial, Gwartney and Connor presented evidence to the jury about how Mrs. Collins, a stroke victim, suffered from resident-on-resident physical assaults, sexual assaults, and ultimately from dehydration, which claimed her life. The Taylor County jury was appropriately outraged and apportioned $10 million of their verdict as punitive damages, to punish the defendant and to deter future similar conduct. He has obtained more than two dozen settlements of $1 million or more in nursing home and medical malpractice cases. His credentials include settlements of a million dollars or more in three different states. Mr. Gwartney is frequently invited to present lectures to other legal professionals in the fields of nursing home litigation and medical malpractice. He has authored several articles in these specialized fields of practice. Mr. Gwartney's practice of law has taken him beyond the borders of his home state, Florida. He is admitted to practice in all state courts in the states of Florida, Georgia, Tennessee, and Texas. He is also licensed to practice in various federal courts in both Florida and Georgia, as well as the Supreme Court of the United States of America. He is a member of the Academy of Florida Trial Lawyers (where he currently serves on the Nursing Home Task Force, and has previously served on the Medical Malpractice Task Force), the Georgia Trial Lawyers Association, the American Trial Lawyers Association, and the Federalist Society for Law & Public Policy (formerly Vice-Chairman, Tallahassee Lawyers Chapter, 1993-94). He is active in his church and community, having served as trustee or on the board of directors for several charitable organizations in the Tallahassee area.
